Below you'll find the the official contest rules for any rewards that Duda offers in the Community, including our Duda All-Stars program. 😊

Duda Contest Official Rules

From time to time, Duda, Inc. (“Duda” or (“Sponsor”) shall create contest(s) to allow Duda customers to earn awards and prizes (each, a “Contest”). Each Contest shall be further detailed on a specific page on Duda.co (“Promotion Page”). These General Terms and Conditions (“Official Rules”) along with the applicable Promotion Page govern the applicable Contest which You (“Entrant” or “You”) have entered. 

Sponsor will conduct the Contest substantially as described in these Official Rules. 

 If You enter a Contest on behalf of a company, You represent and warrant that You are an authorized agent with the authority to enter on its behalf and bind said company. Contests are subject to federal, state, and local laws and regulations and void where prohibited by law.

A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. DUDA CONTESTS ARE VOID WHERE PROHIBITED BY LAW IN AN ENTRANT'S COUNTRY OF RESIDENCE. 

  1. ELIGIBILITY:

Each Entrant must meet these eligibility requirements and any additional requirements on a particular Promotion Page. To enter a Contest, You must: 

  • Be a current Duda customer with no outstanding late payments, suspended accounts, or inactive accounts. Accounts will be verified internally by the Duda team. 
  • Be 18 years of age or older as of their date of entry in this promotion in order to qualify.
  • Meet any Additional eligibility requirements as detailed on a particular Promotion Page. 

Employees, contractors, consultants, officers, directors, and agents of Sponsor, its parent companies, divisions, and subsidiaries, along with their household members and immediate families of the date of entry are not eligible to participate in a Contest or to win any prize. 

Failure to meet the eligibility requirements may result in an entry being invalid and in forfeiture of any prize. 

RESIDENTS IN ANY JURISDICTION IN WHICH THIS TYPE OF CONTEST IS PROHIBITED BY LAW ARE ALSO EXCLUDED FROM PARTICIPATING OR WINNING A PRIZE. 

  1. AGREEMENT TO OFFICIAL RULES: By entering this Contest, You agree to abide by the Sponsor's Official Rules and decisions, which are fully and unconditionally binding in all respects. The Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion. By entering this Contest You represent and warrant that You are eligible to participate based on eligibility requirements explained in these Official Rules. You also agree to accept the decisions of the Sponsor as final and binding as it relates to the content of the Contest.
  2. TO ENTER: Each Contest begins on the date publicized by the Sponsor on the applicable Contest Promotion Page. All entries must be received by the closing time and date defined on the Promotion Page to be eligible to enter the contest or win a prize. Eligible entrants can enter a Contest by following the specific instructions detailed on the Promotion Page. Your entry must fully meet all Contest requirements, as specified in the Official Rules, in order to be eligible to win a prize. Entry information becomes the property of the Sponsor and will not be acknowledged or returned. Entries will be disqualified if they are late, incomplete, and/or do not adhere to the Official Rules or specifications, at the Sponsor’s sole discretion. Any entries attempted through the use of agencies or robotic, repetitive, automatic, programmed, or similar methods will be void.
  3. PRIZES:  Each Contest Promotion Page will detail how an Entrant may win a particular Contest ( the “Winner”) and the prizes that may be awarded. Duda shall determine the Winner based on the Promotion Page criteria and Duda’s determination shall be final.  Any prize details not specified on the Promotion Page will be determined by the Sponsor in its sole discretion. The actual/appraised prize value may differ at the time the prize is awarded. The prize(s) shall be determined solely by the Sponsor. There shall be no cash or other prize substitution permitted except at the Sponsor’s discretion. The prize shall be awarded to the Winner to the email address associated with the Winner’s Duda account. The Winner shall not transfer the assignment of the prize to others nor shall the Winner request the cash equivalent or prize substitution. Sponsor reserves the right to substitute prizes of equal or greater monetary value to the prizes if for any reason any prize cannot be awarded as contemplated in the Official Rules. By accepting the prize, the selected Winner grants permission for the Sponsor to use the Winner’s likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law. 
  4. WINNER NOTIFICATION AND ANNOUNCEMENT: The Sponsor will notify the Winner(s) by email within ten (10) days following Winner selection. The Sponsor is not responsible for nor shall have any liability for Winner’s failure to receive notices for any reason. Furthermore, the Sponsor shall have no liability for the Winner’s provision of incorrect or otherwise non-functioning contact information or for issues arising from email security settings that may cause notifications to be marked as spam or junk email. If the Winner 1) fails to claim the prize within five (5) days from the time the award notification was sent as the first attempt to contact the winner, 2) is found ineligible, or 3) (if applicable) does not complete and return an executed declaration and release within the specified timeframe, the prize may be forfeited and an alternate Winner may be selected. 

If the Winner is unable or unwilling to accept the prize or any portion of the prize for any reason, such winner forfeits their right to the prize and Sponsor shall have no further obligation to such winner. The winner may be requested to sign a Declaration of Eligibility, Liability and Publicity Release. IF THE WINNER VIOLATES ANY OF THESE OFFICIAL RULES, THE WINNER (AT THE SPONSOR’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

  1. PRIZE CONDITIONS: Sponsor is not responsible for lost or stolen prize elements. Prizes may be reported as income to a winner and the winner will be responsible for all taxes associated with the receipt of any prize. Winner(s) may be required to complete required tax forms or other documents requested within the time period stipulated by Sponsor. Winner(s) may be responsible for any costs and expenses not listed herein. Winner(s) will receive their prizes within thirty (30) days from being declared a winner unless notified otherwise. Sponsor reserves the right to cancel or suspend the Contest at any time for any reason, including if the fairness of the Contest is compromised due to reasons outside its control. Proof of identity, age and/or legal residence may be required to claim the prize. 
  2. RIGHTS OF PUBLICITY: By participating in this Contest, wherein participants submit entries (such as photos, written content, or other creative works), You understand and agree that the Sponsor, any individual acting on the Sponsor’s behalf, and the licensees successors, and assigns of the Sponsor shall, where permitted by law, have the right to publish, broadcast, print, distribute, and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, Your submission, name, photo, portrait, voice, likeness, image, statements about the Contest, and Your biographical information for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration. 
  3. INTELLECTUAL PROPERTY. Duda Contest(s) revolve around Entrants providing original works, such as photographs, written content, or other forms of creative output. These submissions must not infringe upon anyone's proprietary or intellectual property rights. In cases where entries breach the intellectual property rights of others, the participant responsible shall face disqualification. Furthermore, any resulting claims arising from such infringement shall be the sole responsibility of the participant. You are obligated to defend or resolve such claims at Your own expense. Moreover, You shall indemnify, defend, and hold the Sponsor harmless from any legal actions, suits, and similar proceedings that arise due to the infringement. If required by law, winners will be expected to sign a Release acknowledging their consent. If You do not want to sign this Release, You should not enter this contest.
  4. GENERAL CONDITIONS: 

Sponsor assumes no responsibility for entries that are incomplete, late, lost, misdirected, or subject to technical malfunctions, human error, interruption, deletion, and defect or line failure related to telephone network, computer equipment, software, or any combination thereof. Entries are void if they are unreadable, inaccurate, incomplete, mutilated, tampered with, forged, mechanically reproduced, irregular in any way, or otherwise non-compliant with these Official Rules.

Although the Sponsor attempts to ensure the contest's integrity, Sponsor is not responsible for actions taken by entrants or other individuals in relation to the contest. This includes attempts to circumvent the Official Rules or disrupt the administration, security, fairness, integrity, or proper conduct of the contest.

Sponsor is not liable for any harm or damage caused to Entrants' or any other person’s computer(s), wireless devices, other equipment, or person(s) related to or resulting from participation in the contest or downloading materials from or using any website in connection with the Contest. 

In the event of any discrepancies between any details in these Official Rules and details in any contest advertising materials, the Official Rules hold precedence.

If unforeseen circumstances arise that hinder the contest's planned execution, such as computer viruses, unauthorized human intervention, legal disputes, acts of nature, industry conditions, bankruptcy or liquidation, applicable law, or any other causes which, in the sole opinion of Sponsor, could corrupt, compromise, undermine, or otherwise affect the administration, security, fairness, integrity, viability, or proper conduct of the contest, Sponsor reserves the right, at its sole and absolute discretion, to cancel, terminate, modify, or suspend all or part of the contest. Sponsor may select winners from eligible entries received before the action is taken or proceed in a manner deemed fair and equitable by Sponsor in its sole discretion.

Furthermore, the Sponsor has the sole right to safeguard any Contest's integrity and may void votes for reasons including, but not limited to, prohibited entry methods (e.g., multiple entries from the same user or computer beyond allowed limits, use of bots, macros, scripts, or other technical means). Any deliberate attempt by an Entrant to harm a website or undermine the legitimate conduct of the Contest may lead to criminal and civil violations. In such cases, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.

In the event of a dispute regarding an online entry, if any, the registered account holder of the email address used for entry will be considered the entrant.

  1. Modifications:  Any Contest, including the terms governing such Contest may be altered, modified or changed, or terminated by Duda, from time to time, at Duda’s discretion. If a Contest which You entered is terminated or a Contest for which You entered is modified to the extent that it materially and meaningfully affects your rights, Duda will notify you by providing you with (3) days notice. Any of the following methods of notice (“Change Notice”) is considered sufficient notice to You of a modification to the or cancellation of a Contest: 
    1. Email notification to the email address registered on Your Account;
    2. Notification on the applicable Promotion Page of the change or termination.

No Change Notice will be required unless such change impacts a Contest for which You entered.  

  1. CONDUCT: SPONSOR RESERVES THE RIGHT, AT ANY TIME AND IN ITS SOLE DISCRETION, TO DISQUALIFY OR DEEM INELIGIBLE TO PARTICIPATE IN THIS CONTEST OR FUTURE SPONSOR PROMOTIONS, ANY INDIVIDUAL THAT SPONSOR SUSPECTS:

(A) IS TAMPERING WITH THE ENTRY PROCESS OR CONTEST OPERATION, OR ANY WEBSITE;

(B) IS IN VIOLATION OF OFFICIAL RULES, SPONSOR’S PRIVACY POLICY, OR OTHER TERMS, CONDITIONS, OR GUIDELINES;

(C) ACTS DISRUPTIVELY, IN BAD FAITH, OR WITH INTENT TO ANNOY, ABUSE, THREATEN, OR HARASS ANYONE OR OTHERWISE VIOLATES ANY TERMS LOCATED AT www.duda.co/terms;

(D) FAILS TO AGREE TO THESE OFFICIAL RULES;

(E) IS IN VIOLATION OF THESE OFFICIAL RULES.

(F) COULD POTENTIALLY REFLECT NEGATIVELY ON SPONSOR’S IMAGE. 

  1. LIMITATION OF LIABILITY: Your entry into this Contest constitutes Your agreement to release and hold harmless the Sponsor and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the Contest and/or the 1) Winner accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.
  2. DISPUTES: The Entrant agrees, as a condition of participating in this promotion, that if any disputes cannot be resolved between the Entrant and the Sponsor, and if causes of action arise out of or are connected with this Contest, they shall be individually resolved exclusively before a court located in Santa Clara County, CA, without resorting to any form of class action. Under no circumstances in any such dispute shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). The participant waives all rights to have damages multiplied or increased. Claims will be brought in the state or federal courts located in Santa Clara County, CA. 
  3. PRIVACY POLICY: Information submitted in connection with the contest will be treated in accordance with these Official Rules and Sponsor’s Privacy Policy (as may be amended from time to time), currently located at ; provided that in the event of any conflict between these Official Rules and such Privacy Policy, the terms and conditions of these Official Rules shall prevail. By entering this contest, you agree that Sponsor may share your personal information for the purpose of verification and prize fulfillments in the event that you are chosen as a winner. 

SEVERABILITY: If any provision of these Official Rules is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Official Rules and shall not affect the validity and enforceability of any remaining provisions. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for convenience of reference and shall not be deeded to affect in any manner the meaning or intent of these Official Rules or any provision thereof. https://www.duda.co/legal/privacy
